Overview

Welcome to Club Riot. The terms “we,” “us,” and “our” refer to Club Riot Gear LLC (“Club Riot”). We operate this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”) to provide you with a curated shopping experience.

Club Riot is powered by Shopify, which enables us to provide the Services.

These Terms of Service (“Terms”), together with any policies referenced herein (including our Privacy Policy and Refund Policy), govern your use of the Services and describe your rights and responsibilities.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

Section 1 – Access and Account

By using the Services, you represent that you are at least the age of majority in your jurisdiction, or that you have consented to allow any minor dependents to use the Services on devices you own or manage.

To access certain Services or make purchases, you may be required to provide personal information such as your email address, billing information, payment information, and shipping address. You represent and warrant that all information provided is accurate, current, complete, and that you have the legal right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

Section 2 – Our Products (Made-to-Order Disclosure)

We strive to accurately display and describe our products. However, colors, scale, and appearance may vary depending on your device, screen settings, lighting, and manufacturing processes.

Many Club Riot products are made-to-order and fulfilled by third-party production partners. Items are often produced specifically after purchase. As a result, minor variations may occur, including differences in print placement, color tone, fabric texture, or finishing. These variations are normal and do not constitute defects.

Product descriptions, pricing, availability, and specifications are subject to change at any time without notice. We reserve the right to discontinue products or limit quantities offered to any person, region, or jurisdiction.

Section 3 – Orders

Placing an order constitutes an offer to purchase. Club Riot reserves the right to accept or decline any order at our discretion, including for reasons such as suspected fraud, pricing errors, or fulfillment limitations.

Orders are not accepted until payment has been received and processed and the order has been confirmed. Please review your order carefully before submitting. Because many items are produced quickly after purchase and/or made-to-order, we may be unable to cancel or modify orders once accepted.

If we do not accept, modify, or cancel an order, we will attempt to notify you using the contact information provided at checkout.

All returns and exchanges are governed exclusively by our Refund Policy.

Chargebacks

Initiating a chargeback or payment dispute without first contacting us to attempt resolution may be considered a violation of these Terms. We reserve the right to limit or refuse future orders from customers who engage in abusive or bad-faith chargeback behavior, to the fullest extent permitted by law. This does not limit your legal rights.

Section 4 – Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed and confirmed.

Unless otherwise stated, prices do not include taxes, shipping, handling, customs, duties, or import fees.

We may offer promotions governed by additional terms. In the event of a conflict, promotion terms will control.

You agree to provide accurate and up-to-date payment information and authorize us to charge your selected payment method for all purchases and associated fees.

We may use fraud-prevention tools, address verification, or payment authorization checks to protect against unauthorized transactions.

Section 5 – Shipping and Delivery

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, weather events, service disruptions, or other circumstances outside our control.

Once products are transferred to the shipping carrier, title and risk of loss pass to you, to the fullest extent permitted by law.

If a package is marked delivered but cannot be located, please contact us promptly so we can assist with carrier investigation procedures.

Section 5A – Sizing, Fit, and Product Use

Sizing and fit are subjective and may vary based on individual preference, body type, and styling choices. Customers are responsible for reviewing size charts, measurements, and product descriptions before placing an order.

Differences in fit or personal preference do not constitute defects. Returns or exchanges related to sizing or fit are governed solely by our Refund Policy.

Section 6 – Intellectual Property

All content on the Services — including but not limited to trademarks, logos, text, graphics, images, videos, designs, product names, and branding — is owned by Club Riot or its licensors and is protected by U.S. and international intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content without prior written consent, except as permitted by law.

“Club Riot” and related branding elements are trademarks of Club Riot. Shopify’s trademarks belong to Shopify. All other trademarks belong to their respective owners.

Section 7 – Optional Tools

The Services may include access to third-party tools or integrations that we do not control. These tools are provided “as is” and “as available,” without warranties or endorsements.

We are not responsible for any issues arising from your use of optional third-party tools. Use of such tools is at your own risk and subject to the third party’s terms.

Section 8 – Third-Party Links

The Services may contain links or embedded content from third parties. We are not responsible for the content, accuracy, or practices of third-party websites or services. Accessing third-party sites is at your own risk.

Section 9 – Relationship with Shopify

Club Riot is powered by Shopify. All purchases made through our store are transactions between you and Club Riot. Shopify is not responsible for any aspect of these transactions.

You expressly release Shopify and its affiliates from all claims, damages, or liabilities arising from purchases made through Club Riot.

We reserve the right to correct errors, inaccuracies, or omissions at any time and to cancel or refuse orders if information is inaccurate, including after an order has been submitted.

You may not use the Services for unlawful, abusive, deceptive, infringing, or harmful purposes, including but not limited to violating laws, infringing intellectual property, harassing others, transmitting malicious code, scraping data, or interfering with the Services.

We may terminate or suspend your access to the Services at any time without notice. You remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination will remain in effect.

The Services and all products are provided “as is” and “as available”, without warranties of any kind, either express or implied, to the fullest extent permitted by law.

We do not guarantee uninterrupted, error-free, or secure access to the Services. Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

Section 16 – Limitation of Liability

To the fullest extent permitted by law, Club Riot and its affiliates shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products purchased through the Services.

You agree to indemnify and hold harmless Club Riot, Shopify, and their affiliates from claims arising out of your breach of these Terms, violation of law, or misuse of the Services.

Section 18 – Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Section 19 – Waiver; Entire Agreement

Failure to enforce any provision does not constitute a waiver. These Terms and referenced policies constitute the entire agreement between you and Club Riot regarding the Services.

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

Section 21 – Governing Law

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law principles. You consent to jurisdiction and venue in California courts.

Section 22 – Headings

Headings are for convenience only and do not affect interpretation.

Section 23 – Changes to Terms of Service

We may update these Terms at any time by posting changes on this page. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
